By Renting From Mobility Etc You Agree To The Following:

The Mobility Etc equipment is the property of Mobility Etc and is in good condition. Renter will return the equipment in the same condition as when received, at the end of the rental period for inspection and recharge of battery (if necessary).If renter wishes to cancel it must be a minimum of 48hrs prior for a full refund cancellations with less than 48hrs is subject to cancel with a maximum of a 50% refund, renters cannot cancel once rental period has began. Each additional day added on after rental has started will be rated at a higher price then what is shown on the website preset prices.If a motorized equipment key is lost, renters will be fined a minimum of $50 which includes the price of the key itself; there are no exemptions to this rule including those with EPP insurance. EPP Basic covers basic damage for manual equipment only and is $3 per day. If damage should occur during the rental period, the Customer is responsible for a $50 deductible for the equipment if it does not exceed 50% percent of total loss. EPP Basic does not cover loss or theft of the rental equipment. The rental cost is not applicable to the deductible. EPP Plus covers damage to the equipment, In addition, it also covers the equipment while only being $5 per day. Customer is responsible for a $30 deductible if it does not exceed 75% percent of total loss. EPP Plus does not cover loss or theft of the rental equipment. The rental cost is not applicable to the deductible. EPP Motorized covers damage to the equipment while only being $15 per day. EPP Motorized does not cover loss or theft of the rental equipment. If damage should occur during the rental period, the Customer is responsible for a $100 deductible if it does not exceed 50% percent of total loss. The rental cost is not applicable to the deductible. If renter declines insurance Mobility Etc shall not be liable or responsible for the loss of or damage to any property left, lost, damaged, stolen, stored by Renter, its agents, or employees, or any other person on the equipment, either before or after the return thereof. Renter assumes all risk of such loss or damage and waives all claims against Mobility Etc by any reason and Renter agrees to hold Mobility Etc not liable for any and all losses, liability claims, damages, injuries, demands, actions and causes of action whatsoever, arising out of or related to any loss, damage or injury claimed by persons that may arise from the use, operation or driving of the equipment, provided that such loss or damage was not caused by the fault or gross negligence and willful misconduct of Mobility Etc or its employees. Renter assumes all costs and expenses of every kind and nature, including legal fees and disbursements arising out of and in connection with the use, operation or driving of the equipment. Renter agrees to pay all costs, expenses, and attorneys fees incurred by Mobility Etc in collecting sums due or in regaining possession of equipment or in enforcing or recovering any damage, losses or claims against Renter. Renter or the driver of the mobility equipment shall in no event be deemed the agent or employee of Mobility Etc in any manner or for any purpose whatsoever.
